Transgender director Sam Feder's newest film "Heightened Scrutiny" provides a compelling two-part viewpoint – both an personal profile of a leading transgender advocate and a critical examination of journalistic reporting surrounding transgender existence.

Judicial Battle at the Highest Court

This documentary documents ACLU attorney Chase Strangio as he gears up for court proceedings in the significant Supreme Court case the Skirmetti case. These proceedings took place in December 2024, with the judiciary eventually deciding in support of Tennessee's position, practically allowing restrictions on medical transition for transgender youth to stay in effect across multiple US territories.

We made Heightened Scrutiny in just 16 months, shared Feder during a conversation. Meanwhile, my earlier film Disclosure took me half a decade, so this was a real push. Our intention was to generate dialogue so people would know more about the case.

Personal Story Amid Legal Struggle

While Feder presents a comprehensive critique of how mainstream media outlets have promoted anti-trans talking points, the film's greatest achievement may be its compelling depiction of Strangio. Normally a cautious attorney in public settings, Strangio shows his humanity throughout the documentary.

This represented a substantial challenge, to reveal parts of my life to a documentary crew that I had made efforts to keep personal, explained Strangio. Feder told me he wanted future generations to know that we tried, to see what was done in defense of these battles for our material survival.

Varied Perspectives in the Struggle

To enhance Strangio's story, Feder incorporates multiple trans advocates, including well-known individuals from activism and entertainment. The documentary also presents insights from non-trans advocates who examine how mainstream media outlets have participated to harmful portrayals of transgender people.

The experience of transgender minors central to the court battle is shown through a remarkable young girl named Mila. Audiences first see her speaking out for her community at a educational meeting, with subsequent moments showing her protesting for trans rights outside the highest court.

Intimate Moments Beyond the Courtroom

Heightened Scrutiny also contains poignant moments where Feder transcends the ongoing political struggle, such as footage of Strangio traveling in Italy and getting a tattoo featuring verses from activist Pauli Murray's poem "Vision."

The tattoo scene is among my most cherished sections in the movie, shared Strangio. Being tattooed is almost like a contemplative experience for me, to be completely aware in my body and to consider it as a container for things that are important to me.

Body Identity and Portrayal

Feder's attention to thoughtfully documenting Strangio getting to his body art underscores that this film is essentially about trans bodies – not only those of young people who face prohibition of their right to live authentically in their own bodies, but also the bodies of the many participants who are featured in the production.

I create films with a message, and part of that is picking people who are outstanding and articulate enough to carry the camera, shared Feder. When people ask me what they should wear for an interview, my response is anything that makes you feel attractive. That is essential to me – as trans people, we face challenges so much with our appearance.

Impact and Optimism

One factor that causes Feder's works excel is his evident ability for making his trans interviewees feel comfortable, seen and appreciated. This technique creates real connection between Feder and Strangio, helping the director to achieve his aim of portraying Strangio as a multifaceted human being and leaving a document for future generations of how resiliently he and others have campaigned for transgender rights.

I don't want people to end up in a situation of constant discouragement because of what the law is failing to provide us, stated Strangio. I strive to be in a practice of using the law to lessen harm, but not to transform it into some type of pathway for our freedom possibilities. Official institutions is not going to be the mirror through which we view ourselves. Our community are that reflection, and it's really vital that we continue having that dialogue in addition to discussions about resisting these policies and approaches.
